Mishmeres Kehuna: Trees Above 3 Lanes Problematic for Kohanim Traveling between Jersey Shore Hospital – Lakewood

traffic gsp tls (4)Kohanim traveiling between JSUMC and Lakewood should be aware of an issue with an area cemetery, says the Vaad Mishmeres Kehuna.

The organization says that there is a Jewish cemetery “with recent internments” which has trees covering three lanes on Route 33 near the Garden State Parkway in Neptune, which could pose a problem according to Halacha.

In order for Kohanim to avoid them, they would need to take another route, the Vaad says.

“Going to Lakewood from Jersey Shore, a Kohen must go with Route 18 South, and going to Jersey Shore, a Kohen may go via Route 18 or via the GSP. However if going via GSP, one must remain in the right lane only on the portion of Route 33 that passes the cemetery.”

  1. Trees can very often create an “Ahel” that transfers the Temua all over the Ahel, just like a Kphen may not go into a house that has a Mes in it so to any Ahel. Regarding comment number 3 if the tress are a Ahel Diarso I don’t think you are correctI and should be bade public.,regardless i am a kohen and a few of my friends asked me if this route is a problem

    a)As you pass the cemetery, it is clearly visible, so would not qualify as safek tuma brishus harabim
    b) also although safek tuma brishus harabim is tahor, there is a machlokes haposkim whether or not it is mutar. many poskim say it is indeed asur.
    c) like any other issur, one must certainly endeavor to avoid the issur, even if he would be a shogeg at worst.
    #4 those trees are schachos so not issur d’oraisa. only issur drabanan
