  1. The commissioner cannot order the legislature to restore the $30 million. The best he can get is a loan, which will be forthcoming anyway, unless Sweeney changes his mind. We do not want another loan

  2. Smart to file a motion through a new docket, and not to pursue the same docket as the Arthur Lang lawsuit. The Lang lawsuit is years in the making and it seems like it may have a substantial success rate. Why risk it by filing emergency briefs and put at risk the years of effort that Mr. Lang put into it? Much better to file under a new docket, which I am glad to see they have now done.
