Governor Phil Murphy said on Friday that New Jersey’s Attorney General Gurbir Grewal will file a lawsuit against the governing body of Asbury Park over their refusal to comply with his Executive Orders. The Asbury Park City Council voted this week to allow its restaurants to have limited indoor dining, in defiance of Murphy’s orders not to do so.
The Asbury Park City Council voted Wednesday evening to permit food establishments to have indoor dining at 25% of the establishment’s capacity, or 50 people, whichever is fewer. The governor announced on Tuesday that he was allowing indoor gatherings of 25% of a building’s capacity or 50 people, whichever is fewer, but specifically said that it did not apply to restaurants.
Governor Murphy came under fire after violating his own Executive Order when he participated in a protest in Hillside, to which the governor said that the protest “feels different.” After an Assemblyman urged NJSP Superintendent Patrick Callahan to issue Murphy a summons for his participation in the protest, Callahan said the enforcement of the executive orders was up to the police in individual towns, rather than the State Police.
When asked whether he would order the State Police to enforce his executive orders in Asbury Park, Governor Murphy said he wouldn’t comment, as it is “subject to legal proceeding.”
