Lakewood resident says Eruv placed near her home without permission is Pasul

A Lakewood resident says an Eruv placed near her home without permission is being Machshil people.

The woman reached out to TLS saying people recently walked into hers and neighbors’ backyards without permission to erect an Eruv on 7th Street between Private Way and Lakewood Avenue, and people are carrying and pushing carriages against Halacha.

The woman says she received a Psak from her Rav that the Eruv is Pasul, as it was not done with consent from neighbors.

All who intend to carry in that area should contact their Rav.

  1. How does one enter another person’s backyard, and erect something without permission? What’s wrong with people?

    Has someone forgotten the concept of מצוה הבאה בעבירה, or is this simply following the trend of being entitled to do whatever one wants, whether it pertains to careless driving, parking in handicapped spots, skipping payments, or demanding that a store take back a worn item, because the customer changed her mind?

    • maybe she has a personal private thing that she doesnt need you and every other yeshivisha guy who is just looking to make issues for everyone!!!!!! she just wants to live in peace so bug off

        • of course i can also be dan him lkaf zchus- he was doing a chesed and helping fellow yidden so they now have an eruv and did not imagine in his wildest dreams that someone would have a problem with chessed

          it it so sad to me that so many people are being machshil because they think theres an eruv:( i wish i had the right answer…… maybe the woman should put up a noticeable sign warning everyone
          imagine if these people knew they were carryiing without an eruv they would be heartbroken

  2. Yes, it may be assur to place an eruv without permission, but since people do rely on the eruv and will carry, it is best to be moichel so that the eruv is not pasul and people are not mechalel Shabbos. This is, as I have heard, the psak of Harav Dovid Feinstein, zt”l.

  3. It is gneivah to use someones property without their permission. Why should should she give permission now? Because, someone has no respect for her annd her property?? And, why the sarcastic comment “she must be a very pleasant person”. I don’t know her and cannot say if she is or isn’t a pleasant person. However, this is HER property, it is not hefker. Noone, has a right to use anyone’s property without permission.
    I think she must be a nice person that she doesn’t remove it and has let it stay on HER PROPERTY. Have common courtesy, respect and integrity become obsolete?

    It’s very disturbing to see some comments. This just encourages people to do what ever they want then guilt people into “Being Mochel”

  5. If someone comes on to my property without permission dressed up as a frum person (as I’m sure no actual frum person would do this) I’m going to stand my ground and protect my property with one of my many guns and there won’t be two different stories in court to tell as to what took place.

  6. Which Ruv did she ask? Stam A-RUV? OR THE A-RUV RAV? Maybe the property is not hers lmaaseh as it is on the North pole. Is it Private way or does it have to do with Lakewood?

  7. She could have simply removed the pole, which is fully within her legal rights.
    For those who are attempting to justify the unlawful invasion of her property, remember that the lady in question could have filed a police report, and it would have taken the investigators less that two minutes to identify the trespasser, and another three to locate him. She didn’t do that, so be grateful.
    Perhaps, in addition to halachos of Eiruvin, the pole sinker and fishline stringer should crack open a Choshen Mishpat, too?

  8. It doesn’t mention if the eruv pole is actually on her property ,or they just walked on her property in order to put it up. If the latter I’m not sure what all the fuss is about.

  9. I’m not sure why she is sending this to TLS. Speak to a rav.
    It’s time Lakewood gets a community wide eruv like every other Frum community in the world. Rav Aaron Zatzal was not refering to todays Lakewood when there is a steakhouse on every corner…
    Thhis is the last thing the Rosh Yeshiva Zatzal would care about…

  11. To tanchum: put up a sign that will likely be ignored, just like a stop sign, yield sign, speed limit sign. It should be tried out though. A gitten hodesh.
