TODAY: Critical Hearing Gets Underway for Rabbi Osher Eisemann, Osher ben Chana Frumit [PHOTOS – UPDATE 2:00 PM]

The case of SCHI founder Rabbi Osher Eisemann can be decided today, when the new judge assigned to the case, Judge Joseph Paone, holds a hearing this morning on the motion for a new trial.

At the hearing, Rabbi Eisemann’s lawyers will present oral arguments as to why the convictions should be thrown out and a new trial ordered.

They will assert that new evidence proves that Rabbi Eisemann is completely innocent of any crime, after a former bookkeeper came forward to testify that it was not Rabbi Eisemann who made the allegedly criminal activity, and that the entire transaction was a simple bookkeeping process. Rabbi Eisemann’s lawyers will also argue that the case must be tossed because the prosecutors hid important evidence during the trial, a flagrant violation of the Brady Act.

If the judge agrees with Rabbi Eisemann’s lawyers, he can rule to vacate the convictions, which will allow the prosecutors to go to a new trial on those two counts, if they should choose to do so. If the judge denies the motion, the case would go to resentencing, with the two convictions carrying up to 20 years in prison R”L. The judge can also decide to order additional hearings before issuing a decision.

Askanim involved in the case have shared that this hearing can be an extremely critical point in the case. They urge the public to continue to daven for Osher ben Chana Frumit.

UPDATE – 2:00 PM: The hearing was over moments ago, and B”H there are some very positive signs for Rabbi Eisemann, Askonim say.

One crucial item announced by  the judge, was that there will not be an evidentiary hearing (for the new testimony to be presented), with the judge stating that it’s not his place to doubt witnesses – that’s for a jury to decide.

However, before the judge makes a decision about a new trial, more documents will need to be submitted to the courts.

A Zoom meeting is scheduled for approximately two weeks from now.

Askonim also noted to TLS that there is no question – based on what they saw today – that the Tefillos of the Tzibur are having a strong impact.

The family asks the Tzibur to continue to be Mispallel for Osher ben Chana Frumit.

  3. There is a story from many years ago, I think the 6-day war, when the Rosh HaYeshiva of the Mir was in a bomb shelter with a lot of people.
    During the bombing and the shelling, a lady stood up in the shelter and she said, ” I am an Agunah for many many years, I forgive my ex-husband (husband) for all the pain that he is doing to me, please Hashem, please forgive your children”.
    The bombing immediately stopped.
    Maybe if we forgive other people and also to try to judge the other person favorably, maybe in that merit, Rabbi Eisenmann will merit a Yeshuah and the whole community at large, with Hashem’s help, we will all merit protection from terrorists like we have seen in the past. With Hashem’s help, we should be Zocheh to walk the streets of Ocean County under the protection of our loving father and all the great wonderful Police Officers.

  5. Not by the FBI, but rather by the NJ Attorney General. In fact, the federal authorities refused to prosecute this case, saying that there was no proof of any wrongdoing.
